Ghocon Terms and Conditions

Application

These general terms and conditions apply unless otherwise agreed.


Formation of Agreement / Order

An order becomes binding on both parties when the customer places an order through Ghocon’s website (www.ghocon.com). A quotation or agreement is considered accepted when confirmed via email. Verbal approval is also binding. An agreement is also deemed to have been formed if it can be demonstrated that the service has been initiated by mutual understanding.


Approval of Draft

Depending on the case, customers will be presented with different options for text, structure, and design. Once the customer approves the final draft, it becomes binding on both parties. Any changes to the structure or design during the production phase must be agreed upon separately.


Responsibility for Content

The customer is responsible for the content they provide, including its accuracy, legal compliance, and intellectual property rights. Ghocon is only responsible for the entirety of the textual content if its production has been ordered as an additional service. Even in such cases, the customer is obligated to verify the accuracy of the content.

Ghocon will proofread content provided by the customer when proofreading is included in the ordered package.


Submission of Images and Usage Rights

Ghocon is responsible for the acquisition and rights of images when image acquisition is included in the ordered package. The customer is responsible for image rights when they provide the images.


Confidentiality

Ghocon commits to maintaining the confidentiality of all materials, documents, and information received from the client, regardless of their physical form, which are either designated as confidential or should reasonably be understood as confidential due to their nature or apparent interest in confidentiality.


Indirect Damages

Ghocon is not liable for indirect damages resulting from delays or defects in service, such as loss of profit or other financial consequential damages incurred by the customer.


Payment Terms

The payment term is 14 days unless otherwise agreed.

If an invoice remains unpaid on the due date, and the delay is not due to Ghocon, Ghocon reserves the right to suspend the service until overdue payments are made or acceptable collateral is provided.

Ghocon also reserves the right to suspend the service if it becomes evident, based on the buyer’s notice or other indications, that the buyer’s performance will be significantly delayed.


Late Payment

If payment is delayed, compensation will be charged for the delay period based on Ghocon’s applicable interest rate, calculated from the invoice’s due date. Ghocon also reserves the right to charge reasonable collection fees.


Force Majeure and Contract Termination

Ghocon is not obligated to fulfill the agreement if natural disasters, fire, technical failure, strike, lockout, war, or other circumstances beyond Ghocon’s control prevent the fulfillment of the contract.

Ghocon is also not obligated to fulfill the agreement if doing so would require sacrifices disproportionate to the benefit the buyer would receive. In such cases, Ghocon is not liable for damages resulting from non-fulfillment of the contract and reserves the right to terminate the agreement.


Termination Period

The termination period for ongoing orders is three (3) months unless otherwise agreed.


Dispute Resolution

Disputes between Ghocon and the buyer regarding the agreement will primarily be resolved through negotiations between the parties. If negotiations fail to reach a satisfactory outcome, disputes will be resolved in the District Court of Helsinki.
